Well, my tenant's lease ended today. She was gave us a month's notice which has also ended. But when we asked for the keys she told that she ill leave by 15 of the month. She tells me to use the security deposit as the rent for these days. Can I file for eviction?
Hi Guest,
Well, your tenant cannot ask you to use the security deposit as rent. This is completely against the state laws. It should be noted here that the security deposit is intended to protect the landlord from financial loss in case damage or violation of the terms of the lease by the tenant. She is liable to pay you the rent for the month of September. You can definitely ask her to vacate the property and if she does not do so, then you can take actions to evict her.
Take care

Welcome Guest,
You should contact a real estate attorney and take his help in filing an eviction lawsuit. Once you get the judgment, you will be able to evict the tenant easily.
