Income tax refund

We recently had to amend our 2008 income taxes. There was a balance due and it was mailed to our home. My husband and I are getting a divorce. The check was issued on 11-13-09. I believe my husband got the check. My question is can he cash or deposit the check in his personal account without my signature?

As far as I can understand the situation, if the check is in your husband's name, then he will be able to deposit the check in his personal account without your signatures.

Thanks for your reply. The income tax check is in both of our names. Can he still cash or deposit the check in his personal account without my signature?

Hi Guest,

Since the check is paid to both of you jointly, he cannot deposit it in his personal account without your signature. The check can be deposited only in a joint account.

that's the key...is the account into which he may have deposited it a joint account? the bank might honor it in that case, though i believe the irs is a stickler in requiring both signatures to appear on the check.
