We signed a lease agreement in 2008 for 1 year and it says we have to give the landlord a two month notice. At that time my landlord had a rental agency that we signed with. After 2 years passed out, the landlord decided to drop the rental agency and we have been paying the rent directly to them. The landlord increased the rent payment few months back and we did not sign a new lease agreement with him. So now we are moving out and I assume we are on a month to month lease so the question is we just have to give them in writing a 30-day notice?
Though you haven't signed any new lease agreement with the landlord and are on month to month lease, you are still bound by the original contract. Depending upon that you will have to give 2 months of notice to the landlord.
Since your original 1 year lease has expired, you are now on a month to month, and the original terms of the lease no longer apply.
It depends on the state. Some states have a law that says leases revert to month-to-month on expiration. Other's don't. If they don't, then the lease rolls over for another term (1 year).
Again, depending on state law, some states say you only give a 30 day notice on a month-to-month. Some say the original terms of the lease controls.
If I were you, I would give the 60 day notice just in case. If there's a dispute, the landlord will keep your security deposit and you will have to sue him to get it back.
