I need help. I have a tenant to whom I had served a 30 days notice and then a 3 days notice and asked him to leave the property. But he will not leave. What can I do? Should I involve the police?

You have given 2 notices to your tenant and still he is not moving out of the property. It is high time that you take legal help. You can contact a real estate attorney and he will help you further in this regard.

Involving the police will not get you anywhere at the moment. Eviction is basically a lawsuit. You have to adhere to the law in your state. In CA for example, you file the tenant a 3 day notice to pay of quit. They don't leave. Your next step is to draft up a formal unlawful detainer. If your tenant is wise, he can fight and challenge the unlawful detainer, taking up months of time and legal expense on both ends. If he is not wise, and sees court documents, he will flee the property. Everything must be done in steps. Once the UD has been filed, state law provides an amount of time the tenant has to answer the UD. Only until the legal time in your state has passed, can you contact your sheriff for legal eviction.
