old refund check

I found and old escrow refund check in the amount of $ 16,000.00 payable to me and it was dated way back april16,2006 . my question is can i still claime that money or can they replaced it with a current check dated 2010 ?
I don't think you'll be able to cash in a check which was payable to you dated April16, 2006. You will have to contact your lender and check out if he's ready to replace the old check with a new one. It would be completely the lender's discretion whether or not he will allow it.

i would hope it's not discretionary for the lender. they issued that $16K for a reason back then, so they ought to be able to live up to that now as well.

Uncashed checks can be subject to an escheatment process where the unclaimed funds are turned over to the state. So it's entirely possible that the servicing company actually no longer has the money.

This applies to payroll checks over 1 year old and may apply in this case as well.

Contact the servicer, and then check with your local state government, and the government in the state the servicer resides.

escheat - i haven't heard that word since i was in branch banking, i think; and that's a while ago. so long that i'd not thought of it in viewing this topic and weighing my own response.

we refinanced with another lender. Our previus loan was with charter one. Will thgey refund money from our escrow account

Hi kris,

If you had money in your escrow account, then the lender is obliged to return that to you. You should contact your lender and ask him to return the escrow money.
