I am presently living in a rental property. We have given notice to the landlord as we cannot afford the property any more. Can he still sue me for the rental payments of the past 2 months?

Unfortunately, yes! The landlord can sue you for the unpaid rent. It doesn't matter whether or not you have served him with a notice.
