Sue me for the rental payments?

I am presently living in a rental property. We have given notice to the landlord as we cannot afford the property any more. Can he still sue me for the rental payments of the past 2 months?

Unfortunately, yes! The landlord can sue you for the unpaid rent. It doesn't matter whether or not you have served him with a notice.

I agree that the landlord has all the rights to sue you for the unpaid rent. You should get in touch with the landlord and discuss your situation with him. May be he can forgive your rent payments.
