Do I owe on the 2nd if mine name is not on the loan?

Posted on: 31st Jul, 2010 11:35 am
I am going through a divorce and we are selling the family home. While we were married I signed documents giving my husband permision to tkae a second out on our home. I am not on the laon, and did not have access to the money, because he did not put it in our joint account. We are now divorcing and selling our house. Am I legally responsible for half of the 2nd mortgage laon? Or do I only owe on the first which my name is on????
I reside in California.

Please help!
hi mitzbritt,

as your name is not mentioned on the second mortgage, you won't be liable for half of the second loan. you will only be liable for the first mortgage where you are listed as a co-borrower.

take care.
