I understand the when living in California your home is automatically homesteaded because of Calfiornia laws. Even so, do I still have to file for homestead exemption? I also understand that even if you have homesteaded your primary home you can still be forced to sell if debtors sue you.
As far as I know, the protection provided by the automatic homestead exemption is separate from that of the protection afforded by a declared homestead. So, in that case, though you have an automatic homestead exemption, yet you would still be able to file for another homestead exemption. As far my knowledge is concerned, homestead exemptions prevent the forced sale of properties. I would suggest you to contact your lawyer and get his opinion in this regard.
