I have a loan from 2005 on a condo in hawaii. I put 175k down and added at least 30k in improvements as it was a fixer upper. I stand to lose all that. ive lost my job and am missing my first payment this month I have it up for short sale at 325k which I owe to the bank. It might get 300k or go to deed in lieu. can they go after my little bit of assets left. Ive been told by a law office this non judicial mortgage issued by countrywide which most were in 2005 is only secured by the property and not to agree to pay anything xtra. Is this correct. I keep reading about defiency judgements in hawaii. can ya please help me.

thanks!!

Hi allstamp1,

Welcome to Mortgage fit,

You have got the right information that in hawaii , lender can not come after your other assets for his financial loss.

Hawaii is a non-recourse state and thus lender can only recover his due amount by selling the mortgage property and can not pursue other assets...

Feel free to ask any further query if you have............
