Refinancing & Grant Deed

Does refinancing a home in California, change the Grant Deed? The Grant Deeds were originally in my husbands name (as he purchased them prior to us getting married). We have since re-financed them, with myself being added to the mortgage. Again, does this change the Grant Deeds?

The grant deed will not change automatically. As your name has been added to the mortgage, you can ask your husband to sign a new grant deed and add your name to the property deed as well.

The reason for asking is that we are in the process of doing a Living Trust. The attorney typed up the Ownership Agreement, showing my husband as having separate properties (the properties we refinanced and that have both our names on the loan), based off the original Grant Deeds. I was concerned as to whether or not the Grant Deeds needed to be in both names. Aside from being on the loan, and the properties being transferred into the trust, is there any reason to change the Grant Deeds to reflect both names at this point?

Hi Charissa,

As your name is added to the mortgage docs, it's better to add your name to the property. This will help you in getting ownership rights to that property.
