Interspousal Trasnfer Deed - California

Posted on: 24th Mar, 2010 02:15 pm
Hello there,
If my husband executes & files an Interspousal Trasnsfer Deed in my favor, which box would be appropriate for him to check so he has not longer ownership. If there'll be creditors running after my husband and wins the judgement, can they put a lien on my property even after the interspousal deed has been recorded?

Thank you so much!!!
Welcome Guest,

Once your husband signs the interspousal transfer deed and transfers the property solely in your name, then he would have no ownership to your property. If your husband's creditors win a judgment against him, they won't be able to come after your property.

As far as filling out the deed is concerned, you should speak to a real estate attorney and take his help in this regard.

if husband transfers property into name of wife, what happens to existing home equity line of credit which is in name of husband only?

Hi jay!

Welcome to the forums!

Though the husband transfers the property, he will still remain liable for the existing home equity line of credit as it is in his name.

Feel free to ask if you've further queries.
