In CA, why my loan application can't go thru withou my wife sign the interspouse tranfer deed? I am the only person on the loan applcation
Hi asianbull!

Welcome to forums!

California is a community property state. Your spouse will have community property interests in any property that you purchase after marriage. Thus, if you default on the mortgage payments, the lender will not be able to recover the dues unless he pays your wife her share of the property. In order to avoid this hassle, the lender wants your wife to sign the inter-spousal transfer deed and release her rights over the property.

Feel free to ask if you've further queries.

Thank you four your help. My wife refused to sign interspouse transfer deed without to see the requirements (she thinks I did it because I want her to give up her right). She wants to see this requirement. Where can I find it? I search on internet and talk to the loan broker and title company, they told me it is a law but they can't show it. Thank you!

You can contact an attorney and he will be able to let you know regarding the requirement.
