Deeds and divorce

My husband quit clamed his interest in our home to me, but his name is still on the mortgage. I was told by an attorney that if we divorce he would regain his interest in the property and the judge would make us sell the house. Help, I don't understand this, didn't my husband hive up all rights to the property when he quit claimed the property to me, with my name being the only name on the deed. Futhermore I was told that while were married I have the right to sell the property or deed it to whoever I wish. None of this makes any sense to me. We live in California, and we both purchased the house after we were married.

Once the property is transferred in your name, then you would be the owner of the property. While going through divorce, the property will not be transferred in your husband's name or sold off. Rather, you can refinance the loan and get it transferred in your name.
