quitclaim deed signed by husband

Posted on: 13th Mar, 2010 09:31 am
When I purchased a very old house; my mother let me use her savings for the down payment; my husband signed a quitclaim deed. Does he have any rights over the house, (he repaired the whole house) . He is an alcoholic, very abusive physically towards me. I live in California and want to divorce him. Thanks for your time!!
Hi bgarciaambriz,

If your husband has signed a quit claim deed and transferred his claims towards the property to you, then he won't have any rights over the house. You should check out the property deed in order to find if his name is mentioned as the owner of the property. If not, then you would be considered as the sole owner of the property.

Thanks
