Joint Tenancy =Right of survivorship

Dear Sir, My wife and I owned a condo in California, the deed title reads "Joint Tenancy" is this equals to the same as right of survivorship. If not, can the deed change from Joint tenancy to Right of Survivorship and with which form.

Hi liaosteve,

If the ownership of the property is mentioned as "joint tenancy with rights of survivorship", then both of you will have survivorship rights on that property. If the ownership is not mentioned in that way, then both of will have to sign a new property deed and change the ownership. In that case, you need to contact a real estate attorney and he would draft a property deed with the required ownership clause in it.
