co-owner who is on the deed passed away

Posted on: 30th Jun, 2010 02:52 pm
My uncle who is the co-owner of my property located in VA as a "tenant in common" on the deed had passed away recently. He was a naturalized US citizen lived in CA. His wife and 4 children (above 18 yrs old) are the non-US residents and are willing to remove his name from the deed without any terms and conditions. He did not have a Will. What is the procedure to complete this process?

Please advise!

Hi vsmanyam,

You can file an affidavit of heirship at the county recorder's office and get the property transferred in your name. This will help you in removing your deceased uncle's name from the property deed. However, you may have to obtain a no objection certificate from your uncle's wife and children.

Thanks
