Company Loan Type APR Est. Pmt.

died in leiu after chptr 7

Posted on: 19th Jan, 2011 07:02 pm
I filed chapter 7 in 2010 and discharged in june, about a month ago I received a call from a mortgage company asking about the property. I informed them I filed chapter 7 on it and I no longer had ties to the home. I was told that the loan got sold to their company and the prior company did not foreclose. They asked me to sign a died in leiu document to take the property out of my name and into theirs. I just want to make sure there is no financial obligation on my end. My attorney did tell me the mortgage company had the okay to take it after the bankruptcy. I dont care to sign as long as they cannot get me for any additional money.
Hi williewalcher!

Welcome to forums!

As you filed bankruptcy and got a discharge, you're not personally liable for any dues. If the property is sold off, the creditor won't be able to come after you in order to recover the deficient balance. In such a situation, you can sign the deed and transfer the property to the collection agency.

Feel free to ask if you've further queries.
