Collection agency asking payment twice!!

Posted on: 18th Apr, 2008 04:36 am
I had to go to court last year for not paying a credit card. before the case was taken to court., I paid off the accnt in full with the collection agency. Now after a year I've received a letter saying they won a judgment against me and want me to pay. I don't have a settlement letter anymore but why should I pay these people twice ?? what option do I have?
Welcome Geoffrey,

If you have paid the due debt then you should have a release letter that you have paid it off. Don't you have any thing to prove that you have paid the debt off? Better consult with a lawyer asap.

Oh my...never throw anything that important away. Always keep it somewhere. I really hope for your sake that you have something to show you paid it. Contact the court regarding this matter and also the creditor who sued you. I wouldn't tell them I didn't have a copy if you don't. Just tell them that ylou recieved a judgement letter for a bill you already paid them. ask them to contact the court that this debt is paid and to send you verifiction they did this. It will get you a new copy of proof you paid...hopefully. Good Luck.

"oh my" indeed. i thoroughly agree - one should never lose or throw away documentation of a paid debt.

depending on how you made that payment, you ought to be able to trace it - whether with a money order you purchased; a bank check; a debit to your bank account, etc.

i think fireyone is correct in suggesting that you contact them concerning your payment and request that they check their records and issue a release from the judgment.

without proof, you could definitely be in jeopardy; but it behooves you to do as much as you can to eliminate this judgment without having to pay it.

Do you have access to a cancelled check or some form of payment, that should work if you don't have the letter. Did they report anything to the court?

Anttime I make any type of large payment I do it through my checking account so I have proof. Hope the op stops in and keeps us updated. I feel bad for him/her.
