can I issue a cease and desist order to the mortage company?

We are talking to our mortgage company to modify the loan but we are still required to pay as agreed until the new agreement has been made.
The attorneys who want to handle this for us said they could issue a cease and desist letter to allow us to stop paying the payments while a new program was worked out.

I would like to know if this is something I can do this myself and what kind of benefits are behind this action?

As your attorneys have told you that you can issue a cease and desist letter, then I think you can go forward. After all attorneys will always look after the benefit of their clients.

Well, I did not know if this was a tool that was used for a pending lawsuit. We are not planning to sue at this time, just put a cushion on the finances until we come to a workable plan. I do not want them to report me as late.

cease and desist what?

didn't you sign a promissory note once that obligated you to make payments on a monthly basis?

i'd be surprised if this were something that you could effectively accomplish, despite what your attorney may be telling you.

Yes, we did and we have been paying them as agreed, but over the past 2 years the loan company started re modify things and change what was required and that had thrown us behind. Its really a mess. Now we are looking at another plan to get things straightened out but it takes 45 days at least. We are just looking for a bit of relief until the new agreement is in place.

The mortgage company cannot re-modify things on its own. I think you need to consult an attorney.
