i had a predatory loan that began with right way financial, then was turned into a world savings mortgage, refinanced with wells fargo, and refinanced again with wachovia. the reason was i had life-threatening illness that caused me to abandon my practice while i received very invasive medical treatment. i am recovered, started my practice again and getting back up to speed. i'll cut to the chase. i have requested the signed copies of all of my mortgage and refinance from wells/wachovia. what i received back (after 5 months of begging) were documents, all of which are not signed on the signature lines. i mean none of them. the lines where my name is typed out on the documents prepared by the lender where one normally signs a legal document are not signed there. nor are any of the document pages initialed by me. what is there instead, are (and this is on all of them) is an entirely separate page, which has been labeled "signature page," with nothing other than that and my signature. also, the mortgage broker, who is also a notary, was the person who also notarized his document, which he had a financial interest in notarizing. i was so despondent and desperate, both due to illness and the thought of losing my home, that i am wondering if i ever actually signed these documents. this all seems highly irregular to me. i have been trying to refinance with hamp and if you want to talk about runarounds....i just discovered out of almost 6 million homes and people qualifying for these loans, only 65,000 have been made. we taxpayers gave the money for this program and the billions of dollars allocated, is obviously being used for something other than what it would be, or what it was intended for. wachovia railroaded me for 6 months, telling me i was being refinanced, but only after hours on the phone, and a lot of digging did i find they had not entered me for hamp at all, but only for a wachovia refinance, on which they presumably make money, while on hamp, they don't. i urge your readers to be very alert. banks are pulling many tricks with this program. they tell me now, they have submitted my hamp application (finally, after 6 months of double-talk.) anyway, i've learned some valuable methods of dealing with these banks and would be happy to share my experience should anyone be interested.

It is good to know that ultimately your lender has submitted the required documents for HAMP. Thus, there are chances that you may get approved for it.

I am looking for an answer to my question about the signatures. Do you know? If they are not right, I am absolved of my obligation to Wachovia.

Hi clieff,

If you can prove that the signature in the mortgage documents are fraudulent, then you may not be liable for the mortgage payments. You can consult an attorney who can guide you and offer you advice in this regard.

My deed of trust from wachovia mortgage was notarized without my presence and knowledge. My signature was authentic. I presume that the cut and paste my signatue. But there's more , the account number of in loan and account number in the deed is entirely different . Will my mortgage will be absolved considering this is fraud, botch notary

As far as I can understand, this can be considered as a mortgage fraud. You should immediately contact a real estate attorney and take his opinion in this regard. You should also check out what type of legal actions you can take against the lender.
