My husband has been receving calls from a law firm names evans law in reference to a 200 loan he received with payday loan yes. We reside in tn. They keep calling harrassing and threatening to have him locked up. The number i have for evans law in buffalo ny is 716-685-8470.

If your husband has taken a payday loan, then he will have to return it. If he does not return the amount, then the payday loan company has the right to sue him for the amount. If your husband has already paid off the dues and still the payday loan company is harassing him, then he can contact an attorney and take legal actions against the company.

if you are being harassed by a creditor, especially in a case such as this in which they are threatening "having him locked up," then you should file a complaint with the federal trade commission (ftc.gov). it is illegal for them to threaten jail or anything remotely like that.
this law firm needs to be reported - please do so.
but also, please, see if you can find a way to pay that loan - that will certainly eliminate the harassment.

apart from all the valuable instructions mentioned above, I will just add that you better respond them and hear what they want to convey....This will surely change the tone in which they are approaching.
If they continue to harrass you, it is better to take a legal help.

that's all wonderful manoj, but if they are threatening to lock someone up, then they are violating the law and ought to be reported to the ftc.

aside from the whole whether or not they can threaten you debate, the question remains as to why the loan hasnn't been repaid.

the nature of this payday loan beast, i am afraid, is that these loans rarely get paid at the time they are due in full. extension after extension and then finally collections agents calling with threats of all sorts of crazy, scary things that will take place.
then (and only then) do we see people seeking help from MortgageFit - how do i call this company...or where are they located....or what do i do now that i didn't make my payments...same story, different day for the most part. it's a sad state of affairs.

Payday loans certainly have tyheir place, but can become a trap if not closely managed. Pay them off promptly and they can be a useful tool to get you out of a bind, forget about them or ignore them and they will ruin your credit and your life.

i agree with your assessment of the situation, wretched. unfortunately, the reality for most payday loan borrowers is that they cannot pay them back promptly, thereby causing renewals and additional expenses. then we continue to see that the companies who grant these loans aren't easy to find, either.
