We live in wisconsin and we surrended a vehicle 5 years ago and they have filed a civil suit. My husband is listed as the one on the suit and he currently makes slightly over minimum wage after losing his good paying job and that is why we voluntarily surrended the car. What are the changes of wage garnishment vs property lien?
I find it pretty odd that the lender would be filing a suit five years after having taken possession of the collateral. Was the vehicle in such poor condition at that time that they couldn't sell it for an amount sufficient to satisfy the debt? That might be the reason they're looking for more money.
But why wait five years? That's the weirdest part of this - did nothing take place in the meantime?
