a year ago chase reported me 1 x 30 late on a mortgage payment. upon contacting them they admitted it appeared my timely payment had been erroneously posted. they promised to review my account and adjust it. at the time i was preparing to refinance and long story short, they never removed the delinquiency. as a result, i was unable to refinance and my credit cards bills rates have skyrocketed and i have suffered severe financial hardship. do i have any hope of having an attorney assisting me and proving damages? i have re-reviewed the payment history and my proof of payment etc. and am sick about what has happened.

It is very important to check your credit report regularly. You have no written proof that they had agreed to update your account. Thus, I am afraid you can do nothing about suing them for this. You can rather send them a 623 dispute letter. If they fail to verify your account, you can then use the proof of your letter to dispute this account with the credit bureaus.

Sandra, thanks for the reply. I do have a confirmation or reference number and the full name (very unusual too) of the person who told me it would be removed. He told me it would be processed within 5 days and I would receive further written correspondence if it was being removed. Nothing ever followed the conversation.

If you have all these proofs then you can dispute this wrong listing off your credit report. Send a dispute letter to the credit bureaus, and along with it attach a copy of the proof of written confirmation.

Now you can do one thing, consult with a good attorney who can help you in a better way. Send legal letters to the lender. You can search for lenders who provides refinance loan, tell them about your financial hardship. Hope everything would be fine soon.
