Cash Transfer Center - Can they garnish my wages?

Posted on: 06th Jul, 2007 04:51 pm
This pdl company, Cash Transfer Centers is threatening that they will garnish my payroll if their amount is not paid back. But after searching about them I found that they operate illegally. Is it correct?

Even then I feel it would be correct for me if I pay back the due but they are not offering any working repayment plan. I know that they cannot garnish wages without taking me to court. And I should submit them a letter as also to my payroll to alert them that I got scammed into signing the payroll garnishment. What I need to do to tell them that I do not accept the payroll garnishment?
Randal,

It is called as wage assignment which they use and not wage garnishment. You are right that their operations are illegal and that is why they cannot garnish.

A wage assignment is voluntary & you can revoke it any time you wish to. In addition to it your company is also not under any legal obligation to honor it.

I have read many complaints against this company as they are into illegal business. This company is very fast in sending the wage assignment to borrower's payroll department. You should inform your payroll dept. before CTC contacts them. They will try to contact them a few times & execute the voluntary wage assignment. I would advice that you immediately send a revocation letter to their mailing address.

Write a letter stating that you revoke any & all wage assignments you may have signed with CTC. And add the names of any of there other affiliates to it. It is likely that they may try to submit the wage assignment letter received from you under name of any different DBA.

Sometime they try wage assignment even when you have sent the revocation letter and because of that it is important to send a copy of the revocation letter you will make to your payroll dept. also.

Thanks

When you send the letter include these dba's also as they use them for the same purpose:

1. Sonic Payday
2. Northway Debit

How long its been that you signed the wage assignment document? Why I am asking is that the assignment is valid for 3 years from the date it is signed but if you have changed your employer in between, then it is valid for 2 years. And can you explain the situation in which you signed which suggests that you were scammed into signing?

Read about canceling wage assignment and how to write revocation letters to creditor and employer from this page: http://www.illinoislegalaid.org/index.cfm?fuseaction=home.dsp_content&contentID=15

Hi Randal,

When you has traced that the pdl company is operating illegally, then talk to an attorney general and can file a case against their illegal threat to you. You should also inform your payroll department and alert them against your wage garnishment. In order to stop the wage deduction yourself, inform your creditor that you are canceling the wage assignment.

Hello Randal,

The pdl company cannot garnish payroll until and unless a judgment has been passed against you. You should first inform the payroll of your company to put a hold on the payroll assignment. If you have the proof that the company is illegal, then, you need to report this to the Attorney General. You can then sue the company for scamming you to sign the payroll assignment.

Hi Randal,

I think you're on the right track actually. It's better to inform your payroll department that the payday loans company will try to garnish your wages by seeking a court order. But that's not all. You need to request the company to offer you a repayment plan. Or else, try to pay off the entire loan amount if you have sufficient savings in your bank or any source through which you can gather a lump sum amount of money.

Good luck!

As you have already complained to the state attorney general, I think, actions will be taken against them.
