Credit Card debt

i thought a credit card had been paid of in a divorce but recently was conatcted saying I still owed. It is not on my credit report (as of yet) and is many years old. They have sent me a notice saying they will settle for half the amount or else they will get a judgement against me. The say they are a collection agancy that but say they are also from a lawyers office. Can they do this with it being 6 years old??
I beleieve the debt needs to be 7 years old for them to not be able to collect.
If it's a joint debt... you are still obligated to pay it. If it is your ex husbands...give them his number.

I would request to know if they are going to report the collection once paid to the bureau. This has a potentially negative effect. Paying off a collection so old, brings the debt current on your report, reflecting derogatory credit.

Hi hopefloats,

It seems that the credit card debt was charged off to a collection agency who have the right to collect the debt from you. If you do not pay they can obtain a judgment against you. However, as Elnora had said, if the debt is in your husband's name you should not be worried about it.

If the collection agency is in the picture then surely it will damage it in both way from OC as well as CA remarks.

So it is advised to you that you should get rid of this debt in order to protect your credit score because fixing it on latter stage is really cumbersome work. :arrow:

I was looking for a personal pronoun in the original post. Not there. Immediate jump by mortgage professionals that the aggrieved party is female. Interesting bias in the lending world but probably politically correct.

Before payign anythign, make sure it is not just an letter or call to collect some extra money.

Talk to the credit card company first to make sure that what they are sayign is true. When they say they are ready to settle for half the amount you owe, that is fishy. That too on a first call.

Just take precautions, before you give your hard earned money to some one.

the avatar i see is a female face, so that would certainly influence someone posting a response.

talking to the credit card company might help, geni; but more specifically, i think hopefloats must obtain documentation from the collection agency of the legitimacy of the debt. if it's no longer valid, then hopefloats should not concern her- or himself with it.
