House mortgage

Posted on: 27th Sep, 2013 01:22 pm
Hi,
I was added on to deed of my in laws house on November of 2012, in California. I was never added on to the mortgage. My father in law recently passed away. When my mother in law passes would the house legally be mine if I'm not on the home loan?
Hi Triixy,

If your name is mentioned on the property deed, then you will be considered the owner of the property up on the death of your mother-in-law. You don't have to be on the loan for the same.

Thanks

Hi Triixy!

Welcome to the forums!

If your name is on the deed, then you are the owner of the property. The house will be yours when your mother-in-law will not be there. In order to claim the whole property and remove your deceased mother-in-law from it, you will have to file an affidavit of heirship at the county recorder's office.

Feel free to ask if you've further queries.
