Can a credit card company put a lien on real estate without first initiating a lawsuit and/or receiving judgment? Does this vary from state to state?
Thank you.
Thank you.
Hi beverly,
As far as I know, in order to place a lien on your property, the lender will have to file a lawsuit and get a judgment. Once he gets the judgment against you, he would be able to place a lien. As per my knowledge, this is same in case of all the states.

I'm not a lawyer, but I agree with adonis. Any creditor will have to sue and receive a judgment first in order to come after your assets. That should be consistent from state to state.
