My husband and I have excellent credit. I have a business that I am about to close. There are 2 credit cards that will be difficult for me to pay back that are in my business's name and mine (not my husband's). We have a prime equity line and a loan from the bank in our names. My husband would like to refinance these two loans in his name. If he does, how long before I can personally file bankruptcy to stop paying these credit cards?

Once he refinances the loan, you should speak to a bankruptcy attorney and discuss your situation with him. The attorney will let you know as to when you should file bankruptcy.

As far as I know, you should wait for at least an year and then file bankruptcy after transferring the property and the mortgage to him.
