Transfer of Deed

Posted on: 24th Mar, 2008 01:28 pm
Hi,

My father just recently passed away. He left the home without transferring any paperwork to my mother and also did not leave a will. No one in my family has power of attorney of my father either. Is there any way that we can transfer the deed of my father's home to my mother? If so, can you please tell me what we can do to get this completed? Any suggestions will be greatly appreciated.

Thank you!
Hi Leila,

Welcome to the forum.

Your mother will have to file an Affidavit of Heirship with the Court and remove your father's name from the deed to get the ownership of the property. If it is a mortgaged property then you should inform the lender about your father's death.

Contact an attorney and he will help you in the process.

Feel free to ask if you have any further questions.

Best of luck,
Larry

Hi,

An affidavit of heirship should be filed in this case. For further information, please refer to a previous discussion on how to transfer deceased owner's property .
