Hi,

I hope that someone can help me. My father in law has an apartment with his sister that is paid for. He gets welfare benefits. I have heard that when he dies the welfare dept can come after his portion of the aprtment?.
Is this true.

In think your father in law has got welfare benefit something like Medicaid. BTW I think the welfare dept can come after his portion of the apartment and put a lien on it.

If the house is paid for why dont you just have your dad transfer the title to you?

"apartment" to me usually indicates lack of ownershi, renting, etc. if that is the case, then the authority making payments would not have recourse to the property, for lack of your dad's ownership of it.

clarify who the owner of the property is at current. that will help answer all your questions. you may also want to discuss this with the welfare department itself.
