My dad passed away in april and the house was in his and my moms name. She wants it in her name and my name now. How do we go about doing that?
What state are you in...state & local laws differ depending on locale?
Hi Hobson.
Welcome to the forum.
I am really sorry to hear about your father. As both you father and mother were on the deed, you mother should get the property on her name. But for that I think your mother need to file Affidavit of Heirship to get the property ownership. And then she can use a quitclaim claim deed to add you on the property.
Feel free to ask if you have any further questions.
Best of luck,
Larry

As we still don't know what state you are in be sure to check their requirements...the county recorder's office should be able to help with the requirements for removing you dad's name.
In CA you can submit a Preliminary Change of Ownership (PCOR) along with a certified copy of the death certificate to have you father's name removed. Then as Lary said you mom can do a quit claim to add you name .
As always I'm not an attorney so to verify check with one...you can usually take advantage of a free consultation (usually 15 min).
I am so sorry for your loss - I remember it well - Good Luck
