Is a quitclaim or interspousal deed necessary to get my name

Posted on: 10th Aug, 2008 11:23 am
Is a quitclaim or interspousal deed necessary to get my name off the title? If the house loan is under my husbands name but my name is on the title as well as his, what can I do to get my name off the title?
Hi rubyredmyka.

The loan is on your husband's name. So you can use a Quitclaim Deed to transfer your share of the property to your husband. You can also use the interspousal deed. But the deed needs to be notarized and recorded in the county recorder's office.

Best of luck,
Larry

hi rubyredmyka,

welcome to the forums.

you can use an interspousal deed to take your husband's name off the title. but are you the cosigner on the loan? if yes, then your husband will probably have to refinance the loan in his name in order to remove you from the loan as well as use a deed in order to take your name off the title.

to know which is better for transfer between spouses, refer to the topic - which is better - quitclaim or interspousal deed?

take care
