my fiancee and i are splitting one week after we closed our purchase on a condo. i am living there and quite capable of paying everything myself, but she wants me to refinance to get her name off the mortgage. rate has gone up almost a point since our lock-in and she refuses to pay any of the consequent costs, can she force me to refinance and have me eat all the costs (refinancing fee plus higher monthly payments due to higher rate)?

I don’t think your fiancee can force you to refinance against your own wishes. But if she can convince your lender to take her name off the mortgage note, then there is a possibility that you may have to refinance.

What I would suggest that you talk to your lender and find out what he feels about it, whether he will allow you for a refinance. Try to negotiate with your fiancee regarding the costs if at all you have to refinance. In the mean time, consult an attorney regarding your situation.
