The home my husband and I own has been in my inlaws name since his previous divorce. My husband wants to have his name on the deed now so we could pull some equity out. Th ecatch is that his mom wants to be remain on the deed because she put some money into the building. What is the best way to handle this?
Hi,
Your husband should try and negotiate with your in-laws so that he can have his name on the deed. In that case, you and your husband can take out the equity in the property in the same ratio in which both of you occupy a share of the property as stated in the deed.
You can also consult an attorney for any further clarification.
Thanks,
Caron.
