subject: quit claim

message: can a quit claim deed be used in an instance where the owners of the property are deceased. my grandmother recently died and her husband died a couple of years before she did, there are three remaining children of my grandmother, my mother and her two sisters, if quit claim cannot be done then will it just need to go to probate court. the sisters are in agreement of having all of their names on the deed.

In my opinion since your grandmother or grandfather have not transferred the property rights by quit claim, you need to go to probate court.

Welcome to the forums,

Here I agree with Zinel, since your grandparents did not transfer there interest in the title of the property to her children then the only option you have is go to the probate court.

But I will still suggest you that you should consult a real estate attorney.
