Should I consult a lawyer while selling my home? I want to sell it on my own. Some of my friends are suggesting me to consult a lawyer.

I think it is appropriate to consult an attorney while trying to sell on your own. He/she can assist you in understanding your rights and can suggest required changes to further protect your interests.

Your friends have wisely suggested getting a lawyer for the purpose. :) In real estate transactions it is always advisable to consult an attorney as there are some complicated rules to be followed.

This is a little difficult to handle for those who are not in that field. There are some basic guidelines in selling a home on your own. To ensure success these guidelines must be followed.

A lawyer can help you with all the legal information required in the sale. He can be helpful in doing the title search for your home. You can seek his help in setting up the offer and including all the required special clauses in the purchase form.

Generally the real estate agents are aware of the rules to be followed and the information that is not with them can be obtained from the lawyer. So, getting a real estate agent and a lawyer will definitely help you in selling a home.

A lawyer can also be useful to give an idea of your mortgage situation. You can get details and options on your present loan that will help your sale.

He can let you know if you can ask the lender whether your mortgage is assumable and if the rates and terms offered are attractive then perhaps the purchaser may want to assume your present mortgage.

He can also suggest whether the mortgage needs to be removed to help the buyer arrange his own financing.
