IS IT A LENGTHY PROCESS TO SELL YOU HOME WHILE IN BANKRUPTCY?
In chapter 13 you can sell your house but you need to fill a from with the trustee asking for permission to sell.

It may take some time depending upon the condition, You need to take help from your bankruptcy attorney.

Based on your circumstances, bankruptcy is not going to stop you from getting your house sold.

There might be some delay and complications but it is usually possible to do. Consult your bankruptcy attorney for the process.

Hi,

While in bankruptcy the trustee normally supervises the sale of your home. They attempt to maximize the selling price of your home so, it may take some time.

For process and application purpose you have to take help from your attorney.

We filed Bankruptcy about 8 months ago. We got a bit behind in our mortgage. The mortgage company filed for relief with the court and it was granted. We have now been able to work with them and we are up to date with the morgage. If we sell our home now that it is no longer in the bankruptcy can we use the money we make to put down on another home less expensive. Will the trustee want us to pay the bankruptcy with what we make after the mortgage company gets paid off.

Hi susan,

If you sell off the property now, you will have to pay off the mortgage dues in full. If you're left with any money, then you can use it as a down payment. However, as you're in bankruptcy, if you sell off your property now, you will have to use the sale proceeds to pay your creditors whom you need to pay through bankruptcy.
