my husband is in the deed but not in the mortgage can he buy now as a firt home buyer?
Hi makialeo,

Your husband cannot qualify as a first time home buyer. As his name is on the deed, he is the legal owner of the property. As per the first time buyer definition, he cannot own a primary residence in the past 3 years to qualify for the $8k tax credit. Since he is on the deed, he already owns a property and cannot be considered as a first time buyer.
