Refinancing and First time homebuyer tax credit?

To make a long story short, my ex and I purchased a home together in 2009 and received the First Time Homebuyers Tax Credit. I amended my 2008 return to receive the money sooner as the house needed alot of work. Since then, we have now split. She lives in the home, but both of our names are still on the mortgage. I know, I am taking a risk and hoping that she pays the mortgage each month. So my question is...we both want my name off the house so that we both do not have to deal with one another. If she refinances, and takes my name off of the home, will we have to pay the tax credit back? Keep in mind, when purchased, we both were FTHB, and that her name will remain on the home and mine will be taken off. I am in desperate need of help, so any clarification would be great.

As both of you were first time home buyers at the time you bought the home, I don't think you will have to return the tax credit. Nevertheless, it will be better if you could contact a tax adviser and take his opinion in this matter.
