Property held subject to a Mortgage

If a Florida probate court awarded you a house in Florida subject to a Mortgage can the lender get a deficiency judgement upon forclosure
Hi Murrayrg!

Welcome to forums!

The probate court has transferred the property in your name. If you have refinanced the mortgage in your name after the transfer of the property, then you would be liable for the mortgage payments. In that case, if the lender forecloses the property, he has the right to sue you for the deficient amount.

Feel free to ask if you have further queries.
