DIVORCING, WHAT HAPPENS TO MY NON MARITAL PROPERTY

Divorcing, what happens to my non marital property? I bought a condo in Florida 3 years prior to getting married. Husband never contribute on mortgage, repairs or anything having to do with the apt. How is this handle during a divorce?

I assume by your post, your husband was never added to the deed or the loan. As long as this is the case, I don't think you don't need to do anything as far as your condo is concerned since it is clearly not a marital asset. You may want to discuss it with your attorney as equitable division of assets are handled differently from state to state.

I would like to add one more thing. If your attorney advises you to get the property appraised, be sure to select an appraiser that specializes in litigation support and expert witness testimony. The cost may be higher than the typical appraisal but it will be well worth it to have someone with courtroom experience.

I bought a house off x wife below market value 1 year prior to vgetting married again kept house and mortgage in my name only 10 years later going for divorce second time she moved out 38months ago her attourney is after equity

Hi Bobbyo,

If your ex-wife had already quitclaimed the property to you, then she cannot claim it as her own or demand the equity from you. I think you should also contact an attorney and take his help in this issue.
