My ex husband passed away Nov 1 in Indiana. We were divorced in 2005. I signed a quit claim deed to Florida property and he filed it in Pasco County but he never refinanced. My name is on mortgage but not on deed. What happens now?

Are you the sole heir to the property? If yes, then you will be able to file an affidavit of heirship at the county recorder's office and get it transferred in your name.

Thanks for the quick reply. He has 4 surviving adult children which is complicating things. I am going to Florida after Christmas is over and hope to get this resolved and sell the property. Would they have to sign an affidavit or quit claim deed over to me? Without going thru court? This whole thing is a mess

If they have no objection to the fact that you are inheriting the property, then the matter can get resolved without going to the court. You should go to Florida, negotiate with them and sort out the matter.
