I am a single retired from federal government 62 year old woman residing in the state of Florida. If my house forecloses and there is a deficiency judgement, can the bank garnish my retirement income? This is all I have to live on even though at times I try and get part time work when it can be found.
Hi kelliejo!
Welcome to forums!
A lender cannot garnish your retirement income in order to recover the deficient amount after foreclosure. However, the lender can definitely garnish your savings account in order to recover his dues. But, for that, he would have to file a lawsuit and get a judgment against you.
Feel free to ask if you've further queries.
