my house is going to court in march for trial for forclusrre. I cannot afford to keep the property as my business has gone down hill in the last few years however can I get late fees and other cost waivered when they take the property as I have no way of paying them.
My daughter is on the deed but not the mortgage what is her rights and liablility?

You can negotiate with the lender and the court in order to get the fees and other costs wavered. It will be their discretion whether or not they will forgive the amount.

Well, talk it out with your lender and see what he or she has to say. If he or she obliges for a waiver, then good for you. Your daughter will get a share when your lender sells off the property.
