my parents messy divorce

My parents divorced several years ago. My mother received a life estate on a piece of property my father received in the settlement to guarantee her alimony which is already guaranteed by a pension (my father should have never agreed to this term and did not understand the significance of it). He now cannot get insurance on this property and has lost valuable rights because of this document. Although my mother does not live there my father does not appear to own this condo. I almost feel the document was drawn up incorrectly since I believe that my father's name should appear on the deed with a clause of a life estate protecting my mother's interest. I'm certain that whoever is reading this believe's that I am confused but I have worked for lawyers in the past. I understand the purpose of a life estate and know that the judge and lawyers should never have proposed this option as a suitable option to protect my mother's interest in my father's pension since she does not and should not reside at said property. You may think that this situation should not be that complicated but my father has been fighting the Florida legal system for the past four years to overturn this situation and my mother hates my father and wants to make him miserable and therefore will not do the right thing and basically the entire family has split up over this issue and it has done tremendous and permanant damage to my family. Please tell me who I should contact to see if this life estate was prepared properly and I hope this answer will offer closure to a two hundred thousand dollar uncontested divorce.

A lawyer will be the best person to help you know whether or not the life estate deed was drawn up in a proper way. You should note that if your mother has a life estate right to the property, then she will be able to live in it until her death. After her death, the clause will become null and void and your father will be the sole owner of the property.
