Could you please clarify what the real property IS OR WAS THEIR MARITAL HOME OR AN INTEREST THEREIN means.
My husband and I bought the condo together in Florida in 2003 but the deed was in my name only. We lived in it for a short time then turned it into a rental.
I quit claimed the property to him in 2007 then we filed for divorce the next month.
Now I am getting a DD-220 saying we might owe doc stamps on the Quit Claim.
The property was sold at the end of Dec of 2008. My husband paid the doc stamps upon that sale.

You will be liable for paying the doc stamps when you quitclaim the property to someone else. You should contact a real estate attorney and take his opinion in this matter. He will be able to guide you in a better way in this regard.
