i am about to sign a quit claim deed from a property that i just close to a llc company own by me and my business partner, we plan to pay everything 50 50. do i have to do something that legally obligates him to pay his half of the mortgage? i am under the impression that i will be the sole responsible for the mortgage.

HI THERE I HAVE 2 QUIT CLAIMS DEEDS ONE ADDING ME TO TILE AND DEED THE GIVING FULL CLAIM HOWEVER THERE IS A MOTGAGE ON THE HOME IOF I RECORD THE ONE QUIT CLAIM TO ME ENTIRETY WHO HA TO PAY MORTGAGE

The person whose name is mentioned in the mortgage deed would be responsible for paying the mortgage dues. However, if the property is transferred to you, the lender will want you to refinance the loan in your name.

the fees will remain the same while you are recording a quit claim deed on a property which has mortgage. however, the grantee to the property will have to refinance the loan once the property transfer is complete.

during divorce I quit claimed my half of the house to my now exhusband. He has not been making the payments....am I responsible for paying the mortgage? Can I get the mortgage company to take my name off the loan?

If your ex-husband has not refinanced the mortgage in his name and has defaulted on the mortgage payments, then the lender has the rights to come after you for the payments. The mortgage company will not remove your name from the documents unless your ex-husband refinances the loan.

A friend of mine signed a quit clam deed during his divorce with the understanding that the house would be refinanced so that he is no longer responsible for the mortgage, but his name is still on the mortgage. How can he go about getting his name off the mortgage and being completely void of any and all responsibility on this home which he can no longer live in?
I live in florida and own a home with my boyfriend both out names are on the deed only his name is on the mortgage...we just broke up and I am moving out of state and dont want to be responsible for anything that happens to the property..can i just sign a quick claim deed and get my name off and what if any money would i have to pay ? including any kind of tax

Your friend will have to ask his ex-spouse to refinance the mortgage in his name. Once the ex-spouse refinances the mortgage, your friend will be released from his liability of paying off the loan.

As your name is not on the mortgage, you can simply sign a quitclaim deed and transfer the property to your boyfriend. Thus, your boyfriend will become the sole owner of the property.

My ex-husband wants me to sign a qiut claim deed but we have 2 mortgages and Benefial Household finacial on the house. I do not want to sign it until the mortgages are in his name. How could I get buy a home if this isn't taken care of? Also, the house was in foreclosure 2 times because he didn't pay on the mortgages.

You shouldn't sign a quitclaim deed unless your husband starts the refinancing process. Unless you're out of these loans, you won't be able to get a new loan to buy a new property.
