We have a forclosed house in Florida in January 2010, if my lender, files for a deficiency judgment and the court approved it for a wage garnishment, will both our wages, my wages and my husbands wage be garnished? and by the way, my husband is in the military, can they garnish his wages. Also if I'd like to consult a lawyer, since, we already moved here in Texas, will I consult a Florida Lawyer or a Texas Lawyer? Thanks.
Hi okik,
If both you and your husband are on the mortgage docs, then the lender can garnish both of your wages. Though your husband is working in military, the lender can garnish his wages. However, if you're working in Texas, the lender will have to file a lawsuit in Texas and get a judgment before he can garnish your wages.
Take care.
