Lender still has not foreclosed

Posted on: 10th Sep, 2008 03:07 pm
I surrendered my home in Dec 2007 after going BK7 but the lender still has not foreclosed on the property so the taxes and property are still in my name. What I am wondering is how long does it take to get another home mortgage. Will it be 2 years minimum from my discharge date or do I have to wait until they finally decide to foreclose and count from there?
Hi katie,

Unless the property is sold off in a foreclosure sale, you will remain the owner of the property. As a result you will be liable for paying the HOA fees and other property charges and taxes.

Thanks

hi,

i filed chapter 7 bankruptcy in 2008 and it was discharged the same year. i included my home in the bankruptcy as well. the bankruptcy is reflected on my credit report and the home i had through bank of america shows it was included in bankruptcy as well. i am in the process of buying a home now and have a closing date of july 19, 2013, but the mortgage company called me yesterday saying the previous property i included in bankruptcy is still showing in my name in the counties' public records versus showing as foreclosed. the counties' public records for the home shows a lis penden, and i have received documents regarding foreclosure too. when i advised the mortgage company of this they said to provide them with these documents just in case, but said that underwriting might slide it through regardless. also, the mortgage company said they have never seen this happen before. can someone please help me in what can be done or let me know if in fact it can slide through underwriting. i would have thought this would have been brought up by the mortgage company at the beginning before having me pay for things like the appraisal, etc., but apparently not. now i already gave my apartment a 30 day notice that i am moving and i am stressing out big time.

thank you!
