Chase assigns mortgage to Real Time Resolutions

hi, i had my mortgage with chase home finance and haven't made a payment in a year to them. i went through the loan modification merry go round with them to no avail. about 3 months ago i recieved a notice from real time resolutions of dallas texas who state they have taken over the mortgage. they seem to be a debt collections agency. chase claims they have charged off the mortgage and i'm wondering what real time can do? it's not a second mortgage its the original. i live in michigan and my understanding is foreclosure is as far as they can go. i've been in mortgage limbo for a year. any advice?
Regardless of the original lender, chances are that your mortgage has probably been sold and the company collecting payments could not prove in court that they have the right to do so. There is rampant fraud being foisted on the uninformed public. One reason that so many modifications never happen is that the loan servicer does not even have the authority to modify the loan, so they string you along, milking as many payments as possible from you until they foreclose. If you don't make them prove anything, they win and you lose. Loan transfers by MERS are particularly suspect. Find an attorney who knows and understands what's really going on and knows how to fight it. I have two homes that I am successsfully defending with the help of my attorney. When you default on a mortgage loan its different than a loan on chaddel property (car,furniture ect) . The property becomes mortgage with the loan being guarantied by the deed. When the mortgage lender forecloses they take the deed to the property and that all they can do. YOU OWE THEM NOTHING. And if you have a second secured by the deed its just bad for them.

help? my dad is eldery. he recieved aletter from realtime solutions. theyare offering to settle his morgage of $26,000. they want $5000.00 has to send it to them b4 april,30. he has been paying on his loan for sometime. is this for real and could it help him

Our home was forclosed on in 2005. We have realtime sending letters wasnting 54000 on a second. I am on disabilitty amd my husband has dementia and does not work .We have moved in with realatives. They are threating us with a lawsuit. Can they do this we have told them every month the situation but still get letters no more phone calls but lots of letters Help

You and your father should read the agreement/docs sent by the Real Time Solutions thoroughly. Before paying off the loan, you should contact the lender and clarify all the doubts. You and your father can even contact a real estate attorney and he will help you further in this regard and let you know whether or not it will be a good option to pay Real Time Solutions.

To bp,

If real time does not receive the payments on time, then they can come after you for the payments. They can even take legal actions against you. You should formally apply for a loan modification in order to get an affordable payment plan to pay off the mortgage.

hi had a 80/20 split with countywide mortgage. i fell on hard times like everyone else in michigan. i applied for a loan modification and it was granted. i recieved my paperwork sign it and get it notarized. i was told to wait 3 months for my new statements to reflect my new terms 4 months passed, and my loan was sold to boa. boa sent me a letter saying the modification was denied. so applied over and over agian , to the tune of 7 times , and every time i would sign the paperwork and have it notarized, and at the last minute it get denied. i finally get fed up and decided to walk away , but later i changed my mind and did not i never once moved out or vacated the property. i tried one more time and got approved everything was good until the rolled my back property taxes into the first mortagae as well. i could not keep up. to make a long story short. last january i recieved a tax statement from boa concerning interest paid on the property, and it informed me that i had left the property abanded , i never left the property , or ever received any type intend to foreclose letter either. i also did not get anything from the court telling me, i had to get out , i also asked my attorney and my tax preparer and they did not know what it meant so the both informed me to go do to my city hall and pull up my property tax statements and they are current and i am the only person listed as the owner. since then i have received my new tax statement for this winter and i am still on there as the owner of the property. earlier that same year i received a notice from rtr telling me that they were taking over my first mortgage. the letter also said that they were willing to help me,needless to say i looked up rtr and i did not like what i saw.so i decided to file chp 13. i went to my conformation hearing and i was approved of a lien strip. the same day i get back from my hearning i get a letter from fedex. it was fro boa and the office of the attorney general from the state of michigan that because of the class action lawsuit , that my second mortgage was going to be paid off and forgiven with no prepayment and it will be closed. it also stated if i was in chp 13 i need to consult with my attorney , because it my affect my repayment plan. i am also one of the people that is in the major class action lawsuit against boa and countrywide. i completed my paperwork in nov. i still was not happy with rtr being on my first mortage , becuase i had to get copies of my title and deed information for chp 13 and i am still on there and also know bank of new york is on there and i have no idea who they are. two weeks later i get a letter from boa on my second mortgage stating that they intend to foreclose ,this is funny because not only am i in chp 13 , but my loan was alway deemed as paid by them and the us gov. i decided to look at my credit reports on my experian it says that my first mortgage is charged off and the second is part of my chp 13 on my transunion it says that my second is paid off and there is a 0 balance and it is closed on the first but under other debt it has the balance of my first mortgage. i am due to receive a settlement amount in the up comming months from the whole countrywide boa lawsuit it can be as little as 400 to 125,000 depending on my situation,they could give me a total because so many people are effected by this . i need to know if i still have rights to my home or if i am paying rtr in chp 13 for nothing. i was under the impression that 1st mortgages could not be collected on. also why was i never served with foreclosure papers , and also how can boa say that i vacated the property when i never left. last but not least is this one of those so called illegal foreclosures ( robo signing) not even reviewing the case. someone please help me out.

welcome to forums!

you should get in touch with your bankruptcy attorney and try to sort out the matter. if you have filed chapter 13 bankruptcy, the lender cannot foreclose the property. if they do so, it will be considered as illegal.

i had a mortgage with bank of america,later it was transferred to rts. know rts is sending us a settlement of the debt at 70% off.is this for real ,should we accept the settlement and payed off?

Hi ivet,

You may accept the deal and get rid of it. But before signing on the dotted lines, you should read the documents carefully. If you have any doubts, then you should get them clarified from the lender.
